Proposal summary
Federal law permits certain non-over-the-counter transfers to a resident of the same state. ATF proposed modernizing the implementing regulations so covered FFLs could use a remote process that includes background-check compliance, remote identity proofing, and electronic notification to the appropriate chief law enforcement officer.
Current status
The public comment period ended August 6, 2026. The proposal is important for future remote-sales workflows, but a proposed rule is not authority to replace the requirements currently in force.
