What changed
ATF’s official library now marks the September 2011 open letter concerning marijuana for medicinal purposes as rescinded. ATF has not identified a replacement marijuana-specific dealer letter on the library page or a separate effective date for the rescission.
What did not change automatically
Rescinding an agency letter is not the same thing as repealing a statute. The federal provisions addressing unlawful users of or persons addicted to controlled substances remain separate legal authority. Dealers should not treat the old letter as operative guidance, but they also should not treat its rescission as a blanket statement that all drug-related prohibited-person issues disappeared.
Operational recommendation
Update counter guides, written SOPs, training, and software notes that quote or paraphrase the 2011 letter as current ATF guidance. For a transaction presenting independent facts that create uncertainty, review current authority rather than replacing one automatic rule of thumb with another.
